A group of TikTok users is suing the state of Montana over its ban on the app.

Governor Greg Gianforte signed the law on Wednesday, which prohibits TikTok from operating in the state and doesn't allow residents to download the app to their phones.

A lawsuit is being filed by five TikTok creators, claiming the ban violates the First Amendment.

The complaint says the state doesn't have the authority to keep people from accessing or creating lawful speech.

The filing also notes “Montana can no more ban its residents from viewing or posting to TikTok than it could ban the Wall Street Journal because of who owns it or the ideas it publishes.”
